Privacy Policy, Cookie Policy, Terms of Use, and Accessibility Statement

LOVERIA CAFFÈ

SECTION I – PRIVACY POLICY

This Privacy Policy describes how Loveria Caffè (“Loveria,” “we,” “us,” or “our”) may collect, use, disclose, retain, and protect personal information in connection with www.loveriacaffe.com (the “Website”) and related website interactions.

1. Scope

This Privacy Policy applies to information collected through the Loveria Caffè Website and to information Loveria receives through website-related customer interactions. It addresses general inquiries, catering requests, newsletter subscriptions, technical website usage information, and information Loveria may receive from third-party reservation and ordering services.

Certain services accessible through the Website are operated independently by third parties, including DoorDash for reservations and Menufy for online To-Go ordering. Information submitted directly to those providers is also governed by their own privacy practices.

2. Information We Collect

The categories of information collected depend on how a visitor interacts with the Website. Loveria does not necessarily collect every category from every visitor.

A. Information You Provide

  • Contact information, such as name, email address, telephone number, and information included in a general inquiry.
  • Catering inquiry information submitted through Gravity Forms, including event-related details voluntarily provided by the requester.
  • Newsletter subscription information, such as an email address and related subscription preferences.
  • Other information voluntarily included in free-text fields or communications.

Based on the current configuration reported by the website administrator, general contact-form submissions are transmitted by email rather than intentionally maintained as a separate contact-form database.

B. Reservation and Ordering Information

Restaurant reservations are facilitated through DoorDash and online To-Go ordering through Menufy. Loveria may receive information from those providers that is reasonably necessary to administer a reservation, prepare an order, provide customer service, or address a transaction-related issue. Information submitted directly to the third-party platform is subject to that provider’s privacy practices.

C. Automatically Collected Data

The Website and its technology providers may automatically receive technical information such as IP address, browser and device characteristics, referring pages, pages visited, dates and times of visits, and other technical or usage information. The precise data depends on the Website configuration and active technologies.

Google Tag Manager is installed and Google Analytics is active. The G4 tag collects only device and behavioral data through cookies and event tracking including pages viewed, click actions, geographic location (derived from anonymized IPs), and device/browser metadata, but does not collect personally identifiable data such as names and email addresses.

3. How We Use Information

Loveria may use information collected through or in connection with the Website for legitimate restaurant, customer-service, administrative, technical, security, and compliance purposes, including to:

  • respond to inquiries and customer-service requests;
  • evaluate and administer catering requests;
  • administer restaurant reservations and online orders;
  • send marketing communications when a visitor has voluntarily subscribed;
  • operate, maintain, troubleshoot, secure, and improve the Website;
  • understand Website performance and usage where applicable;
  • maintain appropriate business records;
  • prevent fraud, abuse, or security incidents;
  • comply with applicable legal, accounting, tax, regulatory, or contractual obligations;
  • establish, exercise, or defend legal claims.

4. How We Share and Disclose Information

Loveria may disclose information to service providers and third parties where reasonably necessary to operate the Website, provide requested restaurant services, administer communications, maintain security, or comply with legal obligations. Such providers may include Website hosting and WordPress-related services, DoorDash, Menufy, Gravity Forms, Google services deployed through Google Tag Manager, Instagram-related functionality, and the newsletter provider once confirmed.

Loveria does not state that it sells personal information for monetary consideration based on the Website practices currently identified. If Website practices materially change, this statement and any legally required opt-out mechanisms should be reviewed.

5. International Data Transfers and Processing

Loveria Caffè is based in the United States. If you access the Website from outside the United States, information collected through or in connection with the Website may be transferred to, stored in, or processed in the United States or other countries in which Loveria’s service providers or their subcontractors maintain operations or infrastructure.

Privacy and data-protection laws may differ among jurisdictions. Loveria will take reasonable steps appropriate to its role and the nature of the processing to comply with applicable requirements. Independent third-party providers are responsible for describing transfer mechanisms or safeguards applicable to information they process independently.

The Website currently uses or provides access to WordPress, Google Tag Manager, Gravity Forms, DoorDash, Menufy, and Instagram Feed. The countries in which a provider processes information may change with its infrastructure and service arrangements.

6. Data Retention

Loveria retains personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected, operate and administer the business, comply with applicable legal, accounting, tax, or regulatory requirements, resolve disputes, and establish, exercise, or defend legal claims.

A. Retention Factors

  • nature and sensitivity of the information;
  • purpose of collection;
  • whether the information remains necessary to provide a requested service;
  • nature and duration of the relationship;
  • legal, accounting, tax, regulatory, or recordkeeping requirements;
  • business record needs;
  • possible disputes, complaints, chargebacks, or legal claims;
  • security and fraud-prevention considerations;
  • whether information can reasonably be deleted, anonymized, or aggregated.

B. Contact and Catering Records

General contact inquiries may be retained for a reasonable period to respond, follow up, maintain business records, and address subsequent questions or disputes. Catering inquiries may be retained while an event is evaluated or administered and, if a transaction results, for appropriate accounting, tax, customer-service, dispute-resolution, and legal purposes.

C. Reservations and Orders

DoorDash and Menufy determine their own retention practices for information maintained on their systems. To the extent Loveria receives reservation or order information, it may retain relevant records for service administration, customer support, transaction records, accounting, tax, dispute resolution, and other legitimate purposes.

D. Newsletter Records

Subscription information may generally be retained while a subscription remains active. After unsubscribe, limited suppression information may be retained where reasonably necessary to honor the preference and demonstrate compliance.

E. Technical Data and Backups

Technical logs and security information may be retained for periods reasonably necessary for Website operation, troubleshooting, security, fraud prevention, and system integrity. Deletion from active systems may not immediately remove residual copies from routine backups, which may be overwritten according to normal backup cycles.

7. Children’s Privacy

The Website is intended for a general audience and is not directed to children under the age of 13. Loveria does not knowingly collect personal information through the Website from children under 13.

If Loveria learns that personal information from a child under 13 has been collected through the Website without appropriate authorization, Loveria will take reasonable steps to investigate and delete information from systems under its control when appropriate and as required by applicable law. A parent or legal guardian may contact info@loveriacaffe.com regarding such a concern.

DoorDash, Menufy, and other independent third-party services maintain their own policies concerning users and minors.

8. Data Security

Loveria recognizes the importance of protecting personal information and takes reasonable administrative, technical, and organizational measures designed to protect information under its control against unauthorized access, use, disclosure, alteration, loss, destruction, or misuse.

  • reasonable Website administration and access controls;
  • maintenance and updating of Website software and components;
  • management of WordPress functionality and administrator accounts;
  • use of reputable technology providers;
  • reasonable monitoring and response to technical or security issues;
  • limiting access to information to persons who reasonably require it for legitimate business purposes.

No Internet transmission, electronic communication, Website platform, hosting environment, plugin, integration, or storage method can be guaranteed to be completely secure. Visitors should avoid submitting highly sensitive information through general forms or ordinary email unless specifically requested and reasonably necessary.

If Loveria becomes aware of a security incident affecting personal information under its control, it may investigate, contain or mitigate the incident, work with relevant providers, take corrective measures, and provide notifications where required by applicable law.

9. Your Privacy Rights and Choices

Depending on where you reside and the laws applicable to your personal information, you may have certain rights or choices. Not all rights necessarily apply to every individual or circumstance.

A. Access, Correction and Deletion

Where applicable, you may request access to personal information maintained by Loveria, correction of inaccurate or incomplete information, or deletion of personal information. Requests may be subject to applicable legal exceptions, verification requirements, and legitimate retention needs.

B. Marketing Communications

If you voluntarily subscribe to promotional emails, you may unsubscribe at any time using the unsubscribe mechanism included in the communication or by contacting Loveria. Unsubscribing from marketing does not necessarily prevent non-promotional communications reasonably necessary for a reservation, order, catering request, customer-service inquiry, or transaction. An unsubscribe option is provided and complies with CAN-SPAM laws.

C. Cookie Choices

Depending on the technologies active on the Website, visitors may manage non-essential cookies through the Website consent interface, browser controls, device settings, or controls offered by third-party providers. Additional information appears in the Cookie Policy.

D. Third-Party Data

Information maintained independently by DoorDash, Menufy, or another provider may require a request directly to that provider. Loveria can address information under its own control but cannot guarantee access to, correction of, or deletion of data controlled independently by another company.

E. Submitting a Request

Privacy requests may be submitted to info@loveriacaffe.com. Please describe the request and provide sufficient information to identify the relevant interaction. Do not send passwords, full payment-card numbers, Social Security numbers, or similar credentials in the initial request.

Loveria may take reasonable steps to verify identity or authorization before fulfilling a request. Where applicable law permits authorized representatives, reasonable evidence of authorization may be requested. Loveria will respond within any legally required period that applies to the request.

10. Contact Us About Privacy

If you have questions, concerns, or requests regarding this Privacy Policy or Loveria Caffè’s handling of personal information, contact:

If the matter concerns a particular interaction—such as a contact inquiry, catering request, reservation, online order, or newsletter subscription—identify that interaction where reasonably possible. Requests concerning information maintained directly by DoorDash, Menufy, or another independent service may need to be submitted to that provider.

Loveria may update this Privacy Policy from time to time to reflect changes in Website functionality, business practices, third-party providers, technology, or applicable legal requirements.

C. Functional and Preference Cookies

Functional and preference technologies may support enhanced features, embedded content, or remembering choices. Disabling certain functional technologies may affect how some Website features operate.

D. Analytics and Performance Cookies

Analytics technologies may help understand Website traffic, pages visited, navigation patterns, referral sources, browser and device characteristics, Website performance, and technical problems. Google Tag Manager is installed, but GTM alone does not establish that Google Analytics is active. Firing tags match the Measurement ID.

2. Third-Party Cookies and Technologies

B. Google Analytics

Google Analytics/GA4 is active, and analytics may collect information concerning pages viewed, Website interactions, referral sources, browser/device characteristics, approximate location derived from technical data, and dates/times of visits.

C. DoorDash

DoorDash may use cookies or similar technologies in connection with its reservation platform. Information collected directly by DoorDash is governed by DoorDash’s own privacy and cookie practices.

D. Menufy

Menufy may use cookies and similar technologies in connection with online ordering, transaction administration, security, preferences, analytics, or other platform functionality. Loveria does not control cookies independently placed on Menufy-controlled services.

E. Instagram Feed

Depending on implementation and visitor interaction, Instagram/Meta technologies may receive technical or interaction information. Meta Pixel is not installed on the Loveria Caffè Website.

F. Gravity Forms

Gravity Forms is used for catering inquiries. Its technical behavior may depend on installed add-ons, anti-spam functionality, and other settings. The forms do not use CAPTCHA/anti-spam services, add-ons, payment integrations, or other third-party functionality.

G. Newsletter Provider

The Website includes a WordPress Subscribe widget (or block) which uses the built-in WordPress.com infrastructure.

3. Cookie Consent and Your Choices

The Website provides an appropriate mechanism for visitors to make choices regarding non-essential cookies and similar technologies. Essential technologies may remain active where necessary to operate or secure the Website.

The consent interface provides clear choices such as Accept All, Reject Non-Essential, and Preferences.

C. Consent Records

A consent-management platform may maintain limited information necessary to remember and respect a visitor’s choices.

  • change Website cookie preferences through the consent interface where implemented;
  • use third-party privacy controls when interacting directly with external services.

  • unlawful, fraudulent, deceptive, or malicious activity;
  • impersonation or material misrepresentation;

  • intellectual-property misuse;
  • false suggestions of sponsorship, endorsement, affiliation, or authorization.

Loveria may take reasonable steps to protect the Website, including restricting abusive traffic, investigating suspected misuse, preserving relevant information, contacting service providers, or referring potentially unlawful activity to appropriate authorities where warranted.

5. Intellectual Property

Website materials may be protected by copyright, trademark, trade dress, and other intellectual-property laws. Protected materials may include the Loveria Caffè name and branding, logos, Website text, restaurant and menu descriptions, photographs, graphics, menus and their original presentation, page layouts, promotional materials, videos, and other original content.

Public availability does not place content in the public domain. Except as expressly permitted by these Terms or applicable law, protected content may not be copied, reproduced, republished, distributed, transmitted, displayed, modified, adapted, sold, licensed, or commercially exploited without authorization.

Third-party names, logos, software, and technologies remain the property of their respective owners. Nothing on the Website grants an implied license to use intellectual property.

6. Third-Party Reservation and Ordering Services

A. DoorDash

Loveria uses DoorDash to facilitate restaurant reservations. Information submitted directly through DoorDash is processed by DoorDash under its own terms and privacy practices. Loveria may receive reservation information reasonably necessary to administer the reservation and provide restaurant services.

Reservation availability depends on capacity, existing reservations, operating hours, and other considerations. Submission of a seating preference or special request does not guarantee accommodation unless expressly confirmed.

B. Menufy

Loveria uses Menufy to facilitate online To-Go ordering. Information submitted directly through Menufy is processed through Menufy and applicable providers under their respective terms and privacy practices. Loveria may receive information necessary to prepare, administer, and fulfill an order.

Menu items, descriptions, prices, availability, and estimated preparation information may change. Payments entered directly into Menufy or an associated payment platform are processed according to the applicable provider’s practices.

C. Third-Party Platform Availability

Loveria does not control the continuous availability or technical operation of DoorDash, Menufy, or other independent platforms. Temporary unavailability of a third-party platform does not necessarily mean that Loveria itself is closed or unavailable.

7. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

Loveria makes reasonable efforts to maintain useful and accurate Website information but does not warrant that the Website will at all times be uninterrupted, error-free, secure, complete, current, or free from technical problems. To the fullest extent permitted by law, Loveria disclaims warranties that may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Menus, prices, restaurant hours, promotions, events, reservation availability, and other information may change. Website publication of a menu item does not guarantee availability.

Food Allergy and Dietary Information

Website content and menu descriptions should not be relied upon as the sole source of information regarding food allergies, intolerances, or dietary requirements. Ingredients, preparation methods, suppliers, and menu items may change, and food may be prepared in environments where allergens are present. Customers with allergies or dietary concerns should communicate them directly to Loveria before ordering or consuming food.

Nothing in these Terms excludes rights, remedies, warranties, or protections that cannot lawfully be excluded or modified.

8. Limitation of Liability

The following limitations apply to the fullest extent permitted by applicable law. Nothing in these Terms excludes, restricts, or limits liability that cannot lawfully be excluded, restricted, or limited.

To the fullest extent permitted by law, Loveria and its owners, affiliates, officers, employees, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to Website access or use, inability to use the Website, reliance on Website information, technical interruptions, or failures occurring solely within independent third-party systems outside Loveria’s reasonable control.

These limitations do not eliminate responsibility for matters directly within Loveria’s control or obligations that applicable law requires Loveria to retain. If a limitation is invalid or unenforceable, it applies only to the maximum extent legally permissible.

9. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Loveria Caffè and its owners, affiliates, officers, employees, representatives, agents, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees where recoverable, arising out of or relating to your misuse of the Website or material violation of these Terms.

This may include unlawful or unauthorized Website use, fraudulent or malicious activity, infringement of another person’s intellectual-property or legal rights, unauthorized interference with Website systems, or conduct causing a third party to assert a claim against Loveria. This provision does not require indemnification for Loveria’s own conduct where prohibited or unenforceable by law.

10. External Links

The Website may contain links to, integrations with, or references to websites, platforms, services, or content operated by third parties, including DoorDash, Menufy, and social media services. External resources are governed by their own terms, privacy policies, cookie practices, and security measures.

The inclusion of an external link does not necessarily constitute endorsement, sponsorship, partnership, affiliation, or a guarantee concerning the third party’s products, services, content, security, or practices. Third-party content may change without notice to Loveria.

Problems with an external link may be reported to info@loveriacaffe.com.

11. Changes to the Website

Loveria may modify, update, suspend, restrict, replace, or discontinue all or any portion of the Website or its functionality from time to time. Changes may affect pages, menus, pricing, hours, reservation or ordering functionality, catering forms, promotional content, third-party integrations, or other features.

The Website or particular features may occasionally be unavailable because of maintenance, updates, technical problems, security concerns, third-party outages, or other circumstances. If material Website changes affect the practices described in legal pages, those documents should be reviewed and updated as appropriate.

12. Termination or Restriction of Access

Loveria may restrict, suspend, or terminate access to all or part of the Website when reasonably necessary to protect the Website, Loveria, customers, service providers, or other users. Grounds may include violation of these Terms, unlawful or fraudulent activity, attempted unauthorized access, malicious or abusive activity, interference with security, misuse of forms, or infringement of legal rights.

Provisions that by their nature should survive restriction or termination—including intellectual property, disclaimers, limitations of liability, indemnification, and governing law—remain applicable to the extent permitted by law.

13. Governing Law

These Terms and disputes arising from or relating to use of the Website will be governed by the laws of the State of Texas, without regard to conflict-of-laws principles, except to the extent another law must apply as a matter of applicable law. Nothing in these Terms is intended to deprive a consumer of protections that cannot lawfully be waived or displaced by contractual choice of law.

14. Severability

If any provision of these Terms is determined by a court or other authority of competent jurisdiction to be invalid, unlawful, or unenforceable, it will be interpreted or limited to the maximum extent permitted by law. If it cannot reasonably be preserved, it will be severed to the minimum extent necessary, and the remaining provisions will continue in effect.

15. Contact and Effective Date

Questions concerning these Terms may be directed to info@loveriacaffe.com.
